1. Acceptance of Terms

By accessing or using CreateStory.ai, you confirm that you have read and understood these Terms and agree to be bound by them.

2. Description of Service

CreateStory.ai generates personalized children's storybooks. You provide details and photos of your child, and our software creates a custom story and illustrations. The Service includes:

3. Eligibility and Accounts

You must be at least 18 years old to use the Service. When you create an account, you agree to provide accurate, current, and complete information, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

4. User Content and Acceptable Use

You retain ownership of the photos and details you upload. By submitting them, you grant us a limited license to use, reproduce, and display that content solely to generate and deliver your storybooks.

You agree not to:

  Upload photos or content you do not have the right to use, including photos of children you are not the parent or legal guardian of

  Use the Service to create content that is unlawful, harmful, or infringes another person's rights

  Attempt to disrupt, overload, or gain unauthorized access to the Service or its systems

  Resell or redistribute the generated storybooks as your own product

  Use the Service in violation of any applicable law

5. Intellectual Property

The storybooks we generate for you are yours for personal use. You may view, download, and print them for your family. The CreateStory.ai website, software, and its underlying technology are the property of Kudometrics LLC and are protected by copyright and other intellectual property laws.

6. Subscriptions and Payments

CreateStory.ai is a subscription service. Plans and pricing are described on our Pricing page. All plans are month-to-month and renew automatically until you cancel. You may cancel at any time from your account settings; cancellation stops future charges and you keep access until the end of the current billing period. All payments are processed securely through Stripe. We do not store your full card details.

7. Refunds

Refunds are governed by our Refund Policy, which is part of these Terms.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, CreateStory.ai disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that a generated storybook will meet your particular expectations.

9. Limitation of Liability

To the maximum extent permitted by law, Kudometrics LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Our total liability to you for any claim arising out of or relating to the Service will not exceed the amount you paid to CreateStory.ai in the twelve (12) months before the claim.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which is part of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for a violation of these Terms.

12. Modifications

We may modify or discontinue the Service at any time, and may update these Terms from time to time. For material changes, we will provide at least 30 days' notice. Continued use after changes are posted means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions.

15. AI-Generated Content

Storybooks are generated by artificial intelligence and may contain errors, generic phrasing, or unintended similarity to other content. CreateStory.ai does not guarantee that any generated story is original, accurate, or appropriate. You are responsible for reviewing any generated story before you share or print it.

16. No Professional Advice

Generated storybooks are provided for personal and entertainment purposes only and do not constitute legal, medical, psychological, educational, or other professional advice.

17. Third-Party Services

The Service relies on third-party providers, including payment processors, cloud storage, and AI generation services. CreateStory.ai is not responsible for the availability, errors, or output of these providers.

18. Indemnification

You agree to indemnify and hold harmless Kudometrics LLC, its affiliates, and their officers, directors, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or your uploaded content.

19. Copyright Infringement

If you believe content generated by or through the Service infringes your copyright, notify us at support@createstory.ai with a description of the copyrighted work and the allegedly infringing content. We will investigate and take appropriate action.

20. Dispute Resolution and Arbitration

You and CreateStory.ai agree to resolve any dispute arising out of or relating to these Terms through binding individual arbitration. Each party waives the right to a jury trial and to participate in any class or representative action. Either party may instead bring a claim in small claims court where applicable.

21. Force Majeure

CreateStory.ai is not liable for any failure or delay caused by events beyond its reasonable control, including outages or failures of third-party services, acts of God, or internet or telecommunications failures.

22. Assignment

Kudometrics LLC may assign these Terms, in whole or in part, in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.

23. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and CreateStory.ai regarding the Service and replace any earlier agreements.

25. Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
